DUTREIL PACT: A TIGHTENING OF THE CONDITIONS

By confirming that, in the then applicable wording of the law, the condition of activity of the company had to be assessed only at the date of the transfer, the Court of Cassation rendered, on 25 May, a decision that was extremely favourable to the taxpayer but that risked weakening the Dutreil mechanism. In the context of the parliamentary debates prior to the adoption of the amended finance law for 2022, the Parliament urgently adopted a correction intended to counteract this case law and avoid abuses.
